What are the conditions for foreigners to buy land in Russia?
In order for the sale and purchase transaction to be legal, you must start with the correct execution of all documents. In addition to the standard set of documents required for any buyer, you will need to provide the following documents:
Notarized passport of the country of your permanent residence;
Visa, if there is a visa regime with your country;
Proof of official residence in the Russian Federation;
Document confirming registration in the Russian Federation (temporary or permanent residence).
It is important to comply with the visa conditions of your stay in the country. If a representative is acting on your behalf, you must have a power of attorney. We’ll do this ourselves.
You must also translate your passport into Russian by notarizing the translated document. The power of attorney must be subject to this procedure. The document must be signed by the translator, which must also be notarized.
The seller will need a separate package of documents. It is advisable to check its completeness and the legal possibility of buying a land plot. This package should include the following:
Confirmation of land rights;
Cadastral passport of the land plot (or an extract from the Unified State Register of Taxpayers);
Consent of the spouse to the transaction;
Waiver of the state’s preemptive right to buy back shares.
But this is not a complete list of documents. A purchase agreement is also required. It must be translated into the buyer’s native language. However, this is not required. After the completion of the procedure, the contract is registered in Rosreestr and the buyer is issued a certificate of ownership (record of an extract from the Unified State Register of Taxpayers).
When can I not buy land in Russia?
Some prohibitions are enshrined in the provisions of the law, while others arise in connection with a specific situation. For example, restrictions may be imposed on a specific land plot or there may be other encumbrances (if it is pledged or under arrest).
